Legal
Terms & Conditions and Hire Agreement — Libhongo Decor & Hire
These terms form a legally binding agreement between Libhongo Decor & Hire (“the Company”, “we”, “us”) and the person or entity hiring goods and services (“the Hirer”, “you”). Placing a booking, paying a deposit or accepting delivery of hired items means you accept these terms.
1. Definitions
“Hired goods” means all tents, chairs, tables, linen, cutlery, crockery, décor, backdrops, carpets and any other items supplied by the Company on hire. “Event date” means the date stated on the accepted quotation or invoice. “Hire period” means the period from delivery until collection by the Company.
2. Quotations & bookings
Quotations are valid for 14 days from the date of issue and are subject to availability of stock on your event date. A booking is only confirmed once the required deposit reflects in our bank account and we have issued written confirmation. Prices are quoted in South African Rand (ZAR) and include VAT where applicable.
Changes to item quantities, venue or event date must be requested in writing at least 7 days before the event date and are subject to availability and price adjustment.
3. Deposit & payment policy
- A 50% non-refundable booking deposit is payable to secure your date and stock.
- The balance is payable no later than 7 days before the event date.
- Bookings made within 7 days of the event date must be paid in full on confirmation.
- We reserve the right to cancel a booking and release stock if payment is not received on time; the deposit is forfeited in that case.
- Accepted payment methods are EFT and cash. Proof of payment must be sent to libhongodecor@gmail.com.
4. Damage, breakage & refundable security deposit
- A refundable breakage/damage deposit is payable together with the balance. The amount is stated on your invoice and depends on the value of the hired goods.
- Hired goods are inspected on collection. The refundable deposit is returned within 7 working days after collection, less the cost of any missing, damaged, burnt, stained or excessively soiled items.
- Where losses or damage exceed the refundable deposit, the Hirer remains liable for the shortfall, payable within 7 days of invoice at full replacement value.
- Linen returned with candle wax, burns, ink, paint or permanent staining is charged at replacement value. Reasonable wear and tear is not charged.
- Tents, décor structures and lighting may not be moved, altered, pinned, taped or decorated by the Hirer or any third party without our written consent.
5. Cancellation & postponement policy
- All cancellations must be made in writing to libhongodecor@gmail.com.
- More than 30 days before the event: the 50% booking deposit is forfeited; any further amounts paid are refunded.
- 15–30 days before the event: 50% of the total contract value is payable.
- 7–14 days before the event: 75% of the total contract value is payable.
- Less than 7 days before the event, or no-show on the day: 100% of the total contract value is payable.
- One postponement to a new date within 6 months may be granted free of charge if requested more than 14 days before the event and stock is available. The deposit transfers to the new date; price differences and any additional transport costs are for the Hirer's account.
- If the Company cancels for any reason within its control, all monies paid are refunded in full within 7 working days.
6. Delivery, setup & collection
Delivery and collection times are arranged in advance and confirmed in writing. The Hirer must ensure safe, level and accessible ground, secure access to the venue, and that a responsible adult is present to receive and hand back the hired goods.
Delivery fees are calculated on distance from Gqeberha. Waiting time caused by venue access delays, after-hours collection or a change of venue on the day may be charged additionally.
7. Care & use of hired goods
Hired goods remain the property of Libhongo Decor & Hire at all times and may not be sub-hired, sold, pledged or removed from the delivery venue. The Hirer must keep them protected from weather, fire and theft for the full hire period, and use them only for their intended purpose.
8. Risk, liability & indemnity
Risk in the hired goods passes to the Hirer on delivery and remains with the Hirer until collection by the Company. The Hirer indemnifies Libhongo Decor & Hire, its employees and contractors against any claim for loss, injury or death arising from the use, misuse or presence of the hired goods at the venue, except where caused by our gross negligence.
Our total liability under any booking is limited to the amount actually paid by the Hirer for that booking. We are not liable for indirect or consequential loss.
9. Force majeure
Neither party is liable for failure to perform caused by events beyond reasonable control, including severe weather, load shedding, fire, flood, civil unrest, road closures or government restrictions. In such cases we will offer a postponement to an alternative date subject to availability.
10. Governing law & dispute resolution
This agreement is governed by the laws of the Republic of South Africa and is subject to the Consumer Protection Act 68 of 2008 where applicable. The parties will first attempt to resolve any dispute amicably; failing that, the parties consent to the jurisdiction of the Magistrate's Court of Gqeberha (Port Elizabeth). No variation of this agreement is binding unless recorded in writing and signed by both parties.
11. Personal information
Personal information supplied through our quote and contact forms is processed in line with the Protection of Personal Information Act 4 of 2013 (POPIA), used only to quote, contract and communicate about your event, and is never sold to third parties. You may request access to or deletion of your information by emailing libhongodecor@gmail.com.
